The Swedish Association of Travel Agents and Tour Operators (SRF) general terms and conditions, agreed upon within the industry on June 28, 2018, apply to the trip, as do the tour operator's special conditions stated below. The special conditions are indicated in italics.
The tour operator (GET OUTSIDE TRAVELS AB, org. no. 559046-2395) has the right to apply special conditions that deviate from the general conditions if the application is justified by the special nature of the trip, specific regulations regarding the mode of transport (such as booking and sales conditions for regular flights), deviating accommodation conditions due to the special nature of the trip, or special circumstances at the destination.
The special conditions may not contradict the Package Travel Act to the detriment of the traveler.
The general and special conditions are part of the agreement.
1. The Agreement
1.1
The agreement becomes binding for the parties when the organiser has confirmed the traveller's booking in writing, unless otherwise agreed. The organiser shall confirm the traveller's booking without delay. The right of withdrawal does not apply to package travel agreements.
1.2
The main traveller is the person in whose name the agreement has been made. The main traveller is listed first in the travel documents or in another clear manner. The main traveller is responsible for payment according to the agreement.
All changes and any cancellations must be made by the main traveller. Exceptions can be made if the main traveller becomes seriously ill and cannot make the change or cancellation.
The main traveller is responsible for providing the organiser with correct booking details for other travellers covered by the agreement. Any refunds will be made to the main traveller.
1.3
If the traveller is under 18 years of age and travels without a guardian, this must be stated at the time of booking. Some trips may require an age limit that may be higher than 18 years. Information will be provided at the time of booking.
1.4
The departure and return times in the booking confirmation are preliminary. The organiser shall, as soon as possible, and if possible no later than 5 days before departure, specify the departure times that will apply for the trip.
1.5
The organiser shall provide general information about what applies regarding passports and visas.
1.6
The organiser shall provide general information about health regulations for the destination.
1.7
Connecting travel or special arrangements are included in the package travel agreement only if these were booked together and at the same time as the services included in the package tour, or if they were sold together with other services for a total price.
1.8
Any requests or special services at the traveller's request are included in the agreement only if these have been expressly confirmed in writing by the organiser.
1.9
The traveller is obliged to check the booking confirmation and travel documents as soon as they have been received, and to ensure that all information is correct, including that names are spelled correctly and match the passport.
Any inaccuracies must be reported immediately. The organiser reserves the right to charge a fee corresponding to the actual cost of correcting incorrect information, as well as reasonable compensation for the additional work caused by the correction.
If the inaccuracy is due to the organiser or someone employed by them, correction shall be made without cost to the traveller.
1.10
The main traveller shall immediately notify the organiser of any changes to address, email address, telephone number or other information of importance for the organiser's ability to contact the traveller.
1.11
For some trips, a minimum number of participants is required for the trip to be carried out. In such cases, the traveller shall receive clear information about this at the latest at the time of booking.
1.12
If flight tickets are part of the package tour, these must be used in the correct order. The traveller can therefore not use only a return ticket when both outbound and return have been booked, or only part of a flight segment.
If the ticket is not used from the start, the remaining parts will be cancelled.
2. PRICE AND PAYMENT
2.1
The price shall be stated in such a way that the total price of the trip is clearly shown. The price shall include all services included in the agreement, as well as mandatory surcharges, taxes and fees. Tips are customary in fishing travel contexts and shall be brought in cash by the traveller.
2.2
The traveller shall pay the price of the trip at the latest by the time stated in the agreement.
2.2.1
A down payment of SEK 2,500 per person, as well as the cost of any cancellation protection/insurance and also the cost of the flight ticket and any other parts that are to be paid immediately. The amount must be paid within 10 days of receipt of the booking confirmation.
2.2.2
The remaining part of the trip's price is to be paid no later than 40 days before departure.
2.2.3
If point 2.2.1 or 2.2.2 falls less than 40 days before departure, the full price of the trip shall be paid within 24 hours.
2.2.4
The tour operator has the right not to send the traveller's travel documents until full payment has arrived at the bank account specified by the tour operator.
2.2.5
In connection with extraordinary bookings outside the tour operator's ordinary range of trips that are not considered test trips, specific payment terms for the trip may be agreed upon. These shall then be clearly stated in email correspondence or printed on the booking confirmation.
3. TRAVELLER'S RIGHT TO CHANGE AND CANCEL
3.1
The traveller has the right to change the agreement if the organiser allows this. Changes to the agreement may entail additional costs for the traveller from the organiser or another party.
3.2
The traveller has the right to cancel the trip. The organiser reserves the right to demand compensation from the traveller for the costs incurred by the organiser as a result of the cancellation.
The organiser may establish reasonable standardised cancellation fees based on the time of cancellation. If the organiser has not established any standardised cancellation fees, the organiser is entitled to a reasonable cancellation fee.
3.2.1
The cancellation fee is:
50% of the trip's price between the time of booking and 40 days before departure.
100% of the trip's price between 39 days before departure and the day of departure.
4. TRAVELER'S RIGHT TO TRANSFER THE AGREEMENT
4.1
The traveler may transfer the agreement to someone who fulfills all conditions for participating in the trip. Such a condition may, for example, be that the transport company or other party engaged by the organizer must accept a change of traveler according to applicable regulations. The traveler must notify the organizer or reseller of the transfer within a reasonable time before departure. Notification made at least seven days before departure is always considered to have been made within a reasonable time.
4.2
The organizer may charge a reasonable fee for the transfer. The fee may not exceed the costs incurred by the organizer due to the transfer. The organizer must show how the cost was calculated.
4.3
The transferor and the transferee are jointly and severally liable to the organizer or reseller for all outstanding payments for the trip and for the extra costs incurred by the transfer.
5. CHANGES BEFORE DEPARTURE
5.1 Change of contract terms
The organizer has the right to make changes to the agreement provided that the organizer informs the traveler about the change in a clear, comprehensible, and explicit manner on a durable medium. If the change is insignificant, for example, minor changes to flight times, the traveler is not entitled to a price reduction or compensation. In the event of significant changes to the trip, the traveler shall, if possible, be offered an alternative trip or the right to terminate the agreement without a cancellation fee.
5.2 Price change
5.2.1
The organizer may increase the price of the trip if the increase is due to changes in fuel costs, taxes and public fees, or exchange rates.
5.2.2
The price of the trip may be increased by an amount corresponding to the traveler's share of the cost increase incurred by the organizer. The right to a price increase only exists if the total cost increase exceeds SEK 100 per booking.
5.2.3
The price of the trip shall be reduced if the organizer's costs, for reasons stated above, decrease by a total of at least SEK 100 per booking. When reducing the price, the organizer may deduct actual administrative costs.
5.2.4
The organizer shall inform the traveler of price changes as soon as possible. The notification shall include a justification for the change and a calculation.
5.2.5
The price may not be increased or decreased during the last 20 days before the agreed departure date.
5.2.6
The organizer may, in its special terms and conditions, waive the right to increase the price according to 5.2.1. In such cases, the organizer does not need to reduce the price according to 5.2.3.
5.3 Traveler's right to terminate the agreement without cancellation fee
5.3.1
If the traveler wishes to terminate the agreement due to a significant change, e.g., if the price is increased by more than 8% of the total price of the package tour, the traveler must notify the organizer of the termination of the agreement within a reasonable time specified by the tour operator from when the organizer informed the traveler about the change. If the traveler does not do so, the traveler will be bound by the new agreement.
5.3.2
If the package tour agreement is terminated, the organizer shall, without undue delay and no later than 14 days after the agreement was terminated, refund the entire price of the trip.
5.4 Organizer's and traveler's right to terminate the agreement in the event of unavoidable and extraordinary circumstances
The organizer has the right to terminate the agreement if the execution of the arrangement is significantly affected by unavoidable and extraordinary events at the destination or in its immediate vicinity. Unavoidable and extraordinary circumstances include, for example, serious security problems such as war, terrorism, outbreaks of serious illness, or natural disasters.
In such cases, the traveler has the right to terminate the agreement without paying any cancellation fee. If the organizer terminates the agreement in accordance with this point, the traveler is not entitled to compensation. In such cases, the traveler is entitled to a full refund in the manner specified in 5.3.2.
5.4.2
The traveler does not have the right to terminate the agreement if the unavoidable and extraordinary events were generally known at the time the agreement was entered into.
5.4.3
To investigate whether the event is of such a serious nature as stated above, expert Swedish or international authorities shall be consulted. From 14 days before departure, a valid travel advisory from the Ministry of Foreign Affairs is grounds for termination if the advisory covers the time of the traveler's trip.
A valid travel advisory from the Ministry of Foreign Affairs shall also be considered grounds for termination if it is otherwise clear that the circumstances underlying the advisory affect or will affect the destination at the time of the traveler's trip.
6. ORGANIZER'S RESPONSIBILITY FOR THE EXECUTION OF THE PACKAGE TOUR
6.1 Defective execution
If a travel service is not performed according to the agreement, the organizer shall remedy the defect within a reasonable time. However, the organizer is not obliged to remedy the defect if it is impossible or if the remedy would entail disproportionate costs. If the organizer does not remedy the defect, the traveler may be entitled to a price reduction and compensation.
6.2 Material defects
6.2.1
If, after departure, a significant part of the agreed services cannot be provided, the organizer shall, if possible, arrange equivalent or at least equivalent alternatives at no extra cost to the traveler. If the organizer cannot offer this, the organizer may offer alternatives of lower quality in conjunction with a reasonable price reduction. The traveler may only reject such alternatives if they cannot be considered comparable to those that would have been provided according to the agreement or if the offered price reduction cannot be considered reasonable.
6.2.2
If the organizer cannot offer any alternative or if the traveler has the right to reject such alternatives according to 6.2.1, the traveler may be entitled to a price reduction and compensation.
6.2.3
In the event of defects that significantly affect the execution of the package tour and which the organizer has not remedied within a reasonable time, the traveler may terminate the agreement and may also be entitled to a price reduction and compensation.
6.2.4
If the organizer cannot offer any alternative or if the traveler has the right to reject such alternatives according to 6.2.1, or if the traveler has terminated the agreement according to 6.2.3, the traveler has the right to equivalent return transport without undue delay and without extra cost if the package tour includes transport and the traveler is at the destination.
6.2.5
Dissatisfaction regarding the size of fish caught and/or the quantity of fish caught is never a fundamental reason for a complaint.
6.2.6
Test trips are always cheaper than the final product.
6.2.7
During test trips, minor unforeseen deviations from the regular itinerary may occur. This is because they are test trips and are sold as such. The fishing and the entire arrangement are completely without any guarantees of quality, as that is what is being tested.
In individual and very rare cases, the tour operator may, due to various factors, also have to cancel or postpone a planned test trip at short notice. In the event of a canceled trip, the paid amount will naturally be refunded, but no further claims for compensation can be made. Point 7.4 of the agreement thus does not apply to test trips. The tour operator does not accept complaints regarding test arrangements. The tour operator wants each test angler to submit a report upon return.
6.2.8
In our remote wilderness camps, in rare cases, some form of rationing of specific food products may occur. This happens when the consumption of a particular item has exceeded our carefully calculated estimates. In these camps, we cannot replenish but have a weekly ration to adhere to. Rationing of this kind cannot be the basis for a complaint.
7 REGARDING PRICE REDUCTIONS AND COMPENSATION
7.1
No price reduction will be granted if the organizer can demonstrate that the defect is due to the traveler.
7.2
The traveler is not entitled to compensation if the organizer shows that the defect is due to the traveler or to a third party unrelated to the provision of travel services included in the package tour, or if the defect is due to unavoidable and extraordinary events.
7.3
If the defect is due to someone the organizer has engaged, the organizer is free from liability for damages according to these travel conditions only if the party engaged by the organizer would also be free according to that provision. The same applies if the defect is due to someone else in a previous stage.
7.4
The right to compensation due to the organizer canceling the trip does not exist if the organizer demonstrates that fewer people than a minimum number specified in the agreement have registered for the trip and the traveler is notified in writing within a period specified in the agreement that the trip has been canceled.
Notification that a trip is canceled must be given no later than:
20 days before departure if the trip lasts longer than 6 days
7 days before departure if the trip lasts between 2 and 6 days
48 hours before departure if the trip lasts less than 2 days
7.5
Compensation according to these terms includes compensation for pure economic loss, personal injury, and property damage. The traveler is obliged to limit the damage as much as possible.
7.6
Unless otherwise limited by the Package Travel Act or other mandatory legislation, the organizer's liability for damages is limited to three times the price of the package tour. However, this limitation does not apply to personal injury or to damage caused intentionally or by gross negligence.
8. COMPLAINTS
8.1
The traveler may only invoke defects in the agreed services if they notify the organizer or reseller of the defect within a reasonable time after they noticed or should have noticed the defect. This shall be done as soon as possible and, if possible, at the destination. When determining any price reduction or compensation for damages, the time at which the traveler complained will be taken into account, if such notification would have enabled the organizer to remedy the defect.
8.2
Notwithstanding point 8.1, the traveler may invoke defects if the organizer or reseller has acted with gross negligence or contrary to good faith and fair dealing.
9. TRAVELER'S RESPONSIBILITY DURING THE TRIP
9.1 Organizer's instructions
The traveler is obliged to follow the instructions for the execution of the trip given by the tour leader or by another person engaged by the organizer. The traveler is obliged to respect the rules of order applicable to the trip and at the destination and to behave in such a way that fellow travelers or others are not disturbed. If the traveler substantially breaches this, the organizer may terminate the agreement without the traveler having the right to compensation or refund.
9.2 Traveler's liability for damage
The traveler is responsible for any compensation in connection with damage that the traveler negligently causes the organizer.
When renting fishing equipment from the organizer's local partners, the principle "if you break it, you buy it" applies. This means that the traveler, regardless of whether the damage occurs intentionally or unintentionally, is obliged to replace the broken equipment with an equivalent amount to the cost of replacing the product with the same or an equivalent model. This also applies if the damage occurs during normal use.
All travelers who rent equipment accept this condition when booking a trip and the additional rental equipment. Any compensation will be settled directly on-site or via the organizer after the trip has ended.
9.3 Traveler's responsibility for formalities
9.3.1
The traveler is solely responsible for observing the necessary formalities for the execution of the trip, such as possession of a valid passport, visa, vaccinations, and insurance.
9.3.2
For all transport services included in the package tour, the traveler must have completed check-in in accordance with the itinerary or other instructions from the organizer or carrier.
9.3.3
The traveler is solely responsible for all costs arising from deficiencies in the said formalities, for example, return transport due to lack of a passport, unless the deficiencies were caused by incorrect information from the organizer or reseller.
9.3.4
The traveler is responsible for taking note of information provided by the organizer.
9.4 Deviation from the arrangement
A traveler who, after the trip has commenced, deviates from the arrangement is obliged to notify the organizer or their representative.
10. ORGANIZER'S OBLIGATION TO PROVIDE ASSISTANCE
If the traveler encounters difficulties during the trip, the organizer is obliged to provide appropriate assistance without undue delay. Such assistance may include, for example, information on health and medical services, local authorities, and consular support. The organizer has the right to charge a reasonable fee for such assistance if the situation was caused intentionally or by negligence on the part of the traveler.
11. DISPUTE RESOLUTION
The parties should try to resolve disputes concerning the interpretation or application of the agreement on their own. If the parties cannot agree, the dispute can be tried by the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, www.arn.se, or by a public court.
A dispute can also be tried via the European Commission's online platform: http://ec.europa.eu/odr.
The tour operator is subject to and complies with Swedish law.
